These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Consistency AI ("Company," "we," "our," or "us"). These Terms govern your access to and use of the Consistency AI mobile application and the website at https://consistencyai.app (collectively, the "Service").

Please read these Terms carefully before using the Service. By creating an account, downloading the application, or otherwise accessing the Service, you affirm that you have read, understood, and agree to be bound by these Terms in their entirety.

1. Acceptance of Terms

By accessing or using the Service, you represent and warrant that:

You are at least thirteen (13) years of age, or the minimum age required in your jurisdiction to enter into a binding agreement.
If you are between 13 and 18 years of age, you have obtained the consent of a parent or legal guardian to use the Service.
You have the legal capacity to enter into and be bound by these Terms.
Your use of the Service does not violate any applicable law or regulation in your jurisdiction.

If you do not agree to these Terms, you must immediately discontinue all use of the Service and delete your account.

2. Description of Service

Consistency AI is a self-trust accountability application designed to help users build and maintain positive habits, track personal goals, manage focus sessions, and cultivate consistency in their daily routines. The Service is available on iOS and Android platforms.

The Service is currently provided free of charge. We reserve the right to introduce premium features, subscription plans, or other paid offerings in the future. Any such changes will be communicated to users in advance and will be subject to separate terms where applicable.

We strive to maintain continuous availability of the Service but do not guarantee uninterrupted or error-free operation. Scheduled maintenance, updates, and unforeseen technical issues may temporarily affect availability.

3. Account Registration

To access the full functionality of the Service, you must create an account using one of the following methods:

Google OAuth (Sign in with Google)
Apple Sign-In (Sign in with Apple)
Email address and password

When registering an account, you agree to:

Provide accurate, current, and complete information as required during the registration process.
Maintain and promptly update your account information to keep it accurate and current.
Maintain the confidentiality and security of your login credentials and not share them with any third party.
Accept full responsibility for all activities that occur under your account, whether or not authorized by you.
Notify us immediately at support@consistencyai.app if you suspect any unauthorized access to your account.

We reserve the right to suspend or terminate accounts that we reasonably believe contain false or misleading registration information.

4. User Responsibilities

As a user of the Service, you acknowledge and agree that:

You are solely responsible for the content you create, store, and manage within the Service, including all habit data, goals, notes, and reflections.
You will use the Service only for its intended purpose of personal habit tracking and self-improvement.
You will comply with all applicable local, national, and international laws and regulations while using the Service.
You will not attempt to circumvent, disable, or otherwise interfere with any security-related features of the Service.
You are responsible for maintaining backup copies of any data you consider critical, as we do not guarantee against accidental data loss.

5. Prohibited Conduct

You expressly agree not to engage in any of the following activities:

Reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code or underlying algorithms of the Service.
Using automated systems, bots, scrapers, or similar tools to access, extract, or interact with the Service without our prior written consent.
Attempting to gain unauthorized access to our servers, databases, or any connected systems or networks.
Transmitting any malware, viruses, worms, or other malicious code through the Service.
Using the Service to harass, abuse, defame, threaten, or intimidate any person.
Impersonating any person or entity, or falsely representing your affiliation with any person or entity.
Using the Service for any commercial purpose not expressly authorized by us.
Interfering with or disrupting the integrity, performance, or availability of the Service for other users.
Circumventing any rate limits, access controls, or other technical restrictions implemented in the Service.

Violation of these prohibitions may result in immediate suspension or termination of your account without prior notice, and may subject you to legal liability.

6. Intellectual Property

6.1 Our Intellectual Property

The Service and all of its components — including but not limited to the software, user interface design, visual elements, graphics, logos, icons, text, algorithms, and underlying technology — are the exclusive property of Consistency AI and are protected by applicable intellectual property laws, including copyright, trademark, and trade secret laws.

Nothing in these Terms grants you any right, title, or interest in the Service or our intellectual property, except for the limited right to use the Service in accordance with these Terms.

6.2 Your Content

You retain full ownership of all content you create within the Service, including your habits, goals, notes, and personal data. By using the Service, you grant us a limited, non-exclusive, non-transferable license to store, process, and display your content solely for the purpose of providing and improving the Service.

This license terminates automatically upon deletion of your account and the completion of our data deletion process.

7. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WARRANTIES REGARDING THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF THE SERVICE OR ITS CONTENT.
WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR FREE OF ERRORS, VIRUSES, OR OTHER HARMFUL COMPONENTS.

Consistency AI is a productivity and self-improvement tool. It is not a medical device, therapeutic program, or substitute for professional medical, psychological, or mental health advice. Any health-related decisions should be made in consultation with qualified healthcare professionals. Please refer to our Disclaimer for additional information.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CONSISTENCY AI, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR:

Any indirect, incidental, special, consequential, exemplary, or punitive damages of any nature.
Any loss of profits, revenue, data, goodwill, business opportunity, or anticipated savings.
Any damages arising from your use of or inability to use the Service.
Any damages arising from unauthorized access to or alteration of your data.
Any damages arising from the conduct or content of any third party in connection with the Service.

In jurisdictions that do not permit the exclusion or limitation of certain damages, our liability shall be limited to the maximum extent permitted by law. In no event shall our total aggregate liability exceed the amount you have paid to us for the Service in the twelve (12) months preceding the claim, or one hundred Indian Rupees (₹100), whichever is greater.

9. Indemnification

You agree to defend, indemnify, and hold harmless Consistency AI, its officers, directors, employees, agents, licensors, and service providers from and against any claims, demands, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

Your use or misuse of the Service.
Your violation of these Terms.
Your violation of any applicable law or the rights of any third party.
Any content you create, submit, or store through the Service.

10. Termination

10.1 Termination by You

You may terminate your account at any time by using the account deletion feature within the app or by contacting us at support@consistencyai.app. Upon termination, your right to use the Service ceases immediately, and your data will be processed in accordance with our Data Deletion Policy.

10.2 Termination by Us

We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice, if we reasonably believe that:

You have violated any provision of these Terms.
Your continued use poses a security risk to the Service or other users.
Termination is required by law or regulatory authority.
We elect to discontinue the Service or any part thereof.

10.3 Effect of Termination

Upon termination, all provisions of these Terms which by their nature should survive — including but not limited to intellectual property provisions, disclaimers, limitation of liability, indemnification, and governing law — shall remain in full force and effect.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be subject to the exclusive jurisdiction of the courts located in India.

Before initiating any formal legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at support@consistencyai.app. We will endeavor to resolve disputes amicably within thirty (30) days of receiving your notice.

12. Modifications to These Terms

We reserve the right to modify, amend, or replace these Terms at any time at our sole discretion. When we make material changes, we will:

Update the "Last updated" date at the top of these Terms.
Provide notification through the app or via email for significant changes that affect your rights or obligations.

Your continued use of the Service after any such modifications constitutes your binding acceptance of the revised Terms. If you do not agree to the modified Terms, your sole remedy is to discontinue use of the Service and delete your account.

13. General Provisions

Entire Agreement: These Terms, together with the Privacy Policy, Cookie Policy, Data Deletion Policy, Refund Policy, and Disclaimer, constitute the entire agreement between you and Consistency AI regarding the Service and supersede all prior agreements, understandings, and negotiations.
Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing.
Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
No Third-Party Beneficiaries: These Terms do not confer any rights upon any person or entity other than you and Consistency AI.
Force Majeure: We shall not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, government actions, or failures of third-party services.
